I, Sue and/or Michael McElwain (seller), guarantee that the puppy is free from life threatening congenital defects for 1 year from the date of birth.
This guarantee applies to the original purchaser only and is not transferable to a second party. Puppies are sold as pet quality with no guarantee as to show potential, temperament, breeding soundness, or as to adult size.
Buyer is to arrange an exam by a licensed veterinarian of their choosing within two business days of receiving their puppy.
If the puppy has been found with a congenital defect that seriously impacts the quality of life, or warrants euthanasia, the buyer must contact the seller immediately. Puppy must not be euthanized without prior written consent from the seller or this guarantee is void. In this event the buyer is responsible for the return of the puppy within three days of the initial veterinarian exam with the veterinary report of the diagnosis.
In case of death before the initial veterinarian exam, the buyer must submit a veterinarian’s necropsy report as to the cause of death.
The seller must be notified immediately in the event of an illness or that the puppy is not eating well before initial veterinarian exam.
Failure to have the initial veterinarian exam within two days, or failure to notify seller of illness or poor eating before the initial veterinarian exam will void this guarantee.
This guarantee is void if the puppy shows any evidence of neglect, abuse, disease, injury, improper nutrition, or viral and bacterial infections. The puppy must be maintained at an appropriate body weight and condition.
If the puppy is female, she must not have been bred during the first 10 months of her life. Buyer’s veterinarian must show proof of basic veterinary care such as vaccinations and parasite control.
This guarantee does not cover:
· Retained baby teeth, grade one or two luxating patella’s, over or under bite, or non-erect ears.
· Issues that are not usually life threatening and common to repair during spay/neuter, such as undescended testicles or hernias.
· Miscellaneous problems that are treatable such as hypoglycemia, coccidiosis, Guardia, parasites, bacterial infection, or any disorders caused by environmental factors.
· Physical problems which result from injury.
Seller will not reimburse veterinary expenses or other expenses incurred by the buyer at any time. This guarantee is limited to a replacement puppy, when one is available, upon return of the puppy within three days of initial veterinarian exam uninjured and unharmed. The buyer must return the puppy with a written veterinarian’s diagnosis that states the congenital life-threatening defect and all paperwork issued at time of sale.
Buyer must have a licensed veterinarian provide proof, and I reserve the right to a second opinion by a veterinarian of my choosing. Whether the buyer is entitled to a replacement puppy or not, all expenses and vet charges incurred by the purchaser after the puppy leaves my home are their sole responsibility.
